I was the one who started the whole investigation. I just wanted them to make their boxes better or transport the glassware in safer boxes because the risk of a huge chunk of glass poking out into someone's hands is quite high. That is really despicable.

Is party Y the only group they ship their packages to in such poor containment? If there are other customers outside of the contract who are being cheated they could have legal grounds to go after party X.

Yup. The company Y is their distributor. So X packages everything, Y picks it up and becomes liable and Y sends it to us for transport.

Any deviation from TL or LTL as a transportation mode, X requires a signed waiver of liability that transfers ownership of the product at X’s dock. Their product comes out of two locations, Perrysburg, OH and Shreveport, LA.  X has the highest damage ratio in both regions for FedEx.  The damage ratio runs between 6 and 7 percent.

X is in a position where they don’t mind if we terminated or refused to pick up their product.  They are fairly confident that UPS would refuse to pick up their product as well.  X is actually in a win either way position. If FedEx refuses pick-up and transport of their product, Y would be forced to buy in larger quantities thus moving their product via LTL.  Y would then be responsible for repackaging of the product for their e-commerce business.  If we continue to pick up this product, X is making more sales as the 6-7% of damages  are getting re-ordered. Result, X sells more product.

Contract or no, this should be legal grounds for a lawsuit.

Also; there is a Jehova's witness who pops around like once every 6 months. Name's Steve. Really nice guy. First time he showed up he was asking me questions about the Bible and I was nailing every question and even showing him passages to reference one question to another. He was kind of surprised by this. He actually didn't bother "converting" me because I surprised him so much. Now whenever he pops around we just chat about life and how things are going with an occasional Bible discussion. Really nice guy and respectful.

There's a game on the 3DS e-shop called comic workshop and it is exactly what it sounds like..... I kinda want it >.>
